    Default Wagering in Daily Fantasy Leagues is CLEARLY gambling

    Why is this even debatable? If people want to gamble on daily fantasy change the laws so gambling is legal. But this is exactly what happened with Poker 8 years ago. It got a little too big and it was shut down even though it is clearly a skill based game. Blackjack is skill too. SO WHAT? Thats NOT the test for whether something is gambling or not.

    ESPN has been derelict in its journalistic responsibility in its reporting on this. They bring on multiple people who all beat up on straw men and claim its clearly legal when it clearly isn't. It turns out they get $250MM from DraftKings next year. Objective journalism? HA!

    Daily fantasy is definitely gambling, and I love it. Gambling shouldn't be illegal anyway.

    I'm not saying anything bad about it. I was an online poker player for a long time. I just think its insane that somehow that isn't legal but fantasy sports is.

    both poker and blackjack are games of chance. There is no skill involved in hitting blackjack or catching (or losing to) a flush on the river. Both have been legally considered "gambling" since their inception.


    Daily fantasy is starting to see a push just like online poker because there are no checks and oversight to it. It's not fair to the player. Both have had instances with insiders playing.

    Daily fantasy should be regulated like other forms of gambling so that its fair to the player.

    The federal government and each state has its own laws and definitions about what gambling is, and on which forms of gambling are illegal. Thus, while I agree that, from a common sense standpoint, daily fantasy betting is gambling, it is not as clear whether it is gambling within the meaning of a states laws, or whether a state has prohibited it. That tends to depend more on who has the strongest lobbies.

    For the little it's worth, I also agree that it's silly to prohibit gambling, sillier still to draw a distinction between Poker and daily fantasy (if anything, there is more skill in Poker), and ironic that the state that is home to the Stock Exchange should take such a dim view on gambling.

    There is most definitely skill involved in poker. However, like you said, it's been considered gambling from the start.

    That is fine, but it has to be heavily regulated, otherwise it becomes stealing. Just like when you walk into a casino you know the dice aren't loaded and the cards are not counted, you have to know that there is a fair chance to win in fantasy sports. We've already seen that bozo take inside information and go play/win on the other site. Shit like that can't happen.

    It's not a dim witted view, NY just wants a piece. They allow horse racing and casinos in NY. I am sure they will allow this once it's regulated.

    Of course it's gambling...and all gambling should be legal and regulated and taxed.

    But, as a nation, we are too stupid to realize that people will gamble and play cards whether it's legal or not...and just pushes the environment more into shady dealings with bookies

    America has this symptom of belief that if they make something legal/regulated it will run rampant and people will "do" it more than if it is illegal. same thing with weed.
