Why would you charge this guy with 1st degree murder? You know damn well he won't be convicted.
1st degree murder has the lesser included charge of 2nd degree murder in Illinois.
The defendant is charged with the offense of first degree murder. The defendant has pleaded not guilty. Under the law, a person charged with first degree murder may be found (1) not guilty of first degree murder; or (2) guilty of first degree murder; or (3) guilty of second degree murder.
Since you have to account for every shot you take, first degree murder should apply.

Either way, though, the cop was in the wrong. Shooting a kid 17 times going in the opposite direction in an empty street.

Could have taken him down without the use of excessive force but I doubt the cop will get convicted for this.

Yeah after seeing the video it was clearly a bad shoot. Oh well, a bad cop off the street and a Darwin Award winner...given posthumously of course.

Here the Illinois first degree murder standard
A person commits First Degree Murder when:
(a) they kill an individual without lawful justification if, in performing the acts which cause the death:
(1) they either intend to kill or do great bodily harm to that individual or another, or know that such acts will cause death to that individual or another; or
(2) they know that such acts create a strong probability of death or great bodily harm to that individual or another; or
(3) they are committing, or attempting to commit, a forcible felony other than second degree murder.
I'm no lawyer... but maybe it is premeditated first degree murder.
Any legal minds?

Going to be pretty hard for his lawyer to argue he didn't know that firing every bullet in his clip might cause great bodily harm to someone.
